The Florida Fish and Wildlife Conservation Commission (FWC) is implementing several
new boating laws, with some taking effect on July 1, 2025. These changes include the
Boater Freedom Act, which restricts law enforcement's ability to stop or board vessels
without probable cause, and new regulations regarding vessel ownership and at-risk
vessels. Additionally, the FWC is clarifying boating regulations and enhancing safety
measures for Florida's waterways.
Here's a look at some of the new laws:
1. Boater Freedom Act:
This act, signed into law by Governor DeSantis, restricts law enforcement from stopping
or boarding a vessel without probable cause or a suspected violation.
This means officers need a valid reason, such as a suspected violation of boating laws,
before they can initiate a stop.
2. New Regulations for Vessel Ownership and At-Risk Vessels:
The definition of "vessel owner" is clarified, and a valid vessel title is now considered
prima facie (presumed) evidence of ownership.
Vessel owners are now required to undergo an Effective Means of Propulsion (EMP)
evaluation upon request by law enforcement, particularly for at-risk or derelict vessels.
This evaluation helps determine if the vessel has an effective means of propulsion and if
the owner is capable of operating it safely.
If an officer believes a vessel lacks an effective means of propulsion, the evaluation
must be conducted immediately or within 48 hours if notified.
3. Other important updates:
Boating Safety Education:
Anyone born on or after January 1, 1988, must complete a NASBLA (National
Association of State Boating Law Administrators) -approved boating safety course or
equivalency exam and carry the corresponding identification card and a photo ID when
operating a motorboat with 10 horsepower or more.
Vessel Safety Equipment:
All recreational vessels are required to carry specific safety equipment based on their
size and type.
Florida Freedom Boater Decal:
A new state law requires boat owners/operators to demonstrate compliance with
boating safety equipment requirements at the time of vessel registration or renewal.
Those who sign an attestation form indicating compliance with Florida boating safety
equipment requirements will be issued a Florida Freedom Boater Safety inspection
decal by county tax collector or license plate agent offices. The attestation form and
decal are expected to be available later in 2025.
